CERTIORARI TO THE CIRCUIT COURT OF APPEALS

FOR THE SEVENTH CIRCUIT

Syllabus

Section 6(b) of the Grain Futures Act, which provides that, if the Secretary of Agriculture has reason to believe that any person "is violating" the Act or the regulations thereunder, or "is attempting" to manipulate the market price of grain in violation of the Act, he may require such person to show cause why he should not be suspended from trading in Contract Markets, cannot be construed as authorizing suspension for wrongdoing that occurred more than two years before the filing of the complaint with the Secretary. P. 236.

Certiorari, 297 U.S. 701, to review a decree setting aside on appeal an order whereby the commission established by the Grain Futures Act directed all "contract markets" (grain exchanges designated by the Secretary of Agriculture) to refuse to the respondent Cutten all trading privileges for the period of two years.
